These Terms and Conditions (“Terms”) govern your access to and use of the Formelle App, website, content, programs, services, and related features (collectively, the “Services”) operated by Formelle (“Formelle,” “we,” “our,” or “us”).
By accessing, downloading, purchasing, registering for, or using the Services, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not use the Services.
1. Eligibility
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the Services independently. If you are under the required legal age, use of the Services must be supervised and approved by a parent or legal guardian. By using the Services, you represent and warrant that you have the legal authority to enter into these Terms, all information you provide is accurate and current, and your use of the Services complies with applicable laws and regulations.
2. Health and Fitness Disclaimer
Formelle provides fitness, wellness, nutrition, educational, and lifestyle content for informational purposes only. The Services are not medical services and do not constitute medical advice, diagnosis, treatment, or professional healthcare recommendations. You acknowledge and agree that participation in physical exercise carries inherent risks; you are voluntarily participating at your own risk; you are responsible for consulting a physician or qualified healthcare provider before beginning any fitness, nutrition, or wellness program; and Formelle is not responsible for injuries, health complications, or damages resulting from use of the Services. If you experience dizziness, pain, discomfort, shortness of breath, or any medical concern, discontinue use immediately and seek medical attention.
3. User Accounts
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials, restricting unauthorized access to your account, and all activities occurring under your account. You agree to notify us immediately of any unauthorized access or security breach. We reserve the right to suspend, restrict, or terminate accounts at our discretion where we believe these Terms have been violated.
4. Subscriptions and Billing
Certain features of the Services require a paid subscription. By purchasing a subscription, you agree that subscription fees will be charged automatically on a recurring basis unless canceled prior to renewal; pricing may vary by region, platform, promotional offer, or subscription tier; and taxes may apply where required by law. Subscription management and cancellation may be handled through the Apple App Store, Google Play, direct web billing providers, or third party payment processors. You are responsible for managing your subscription through the platform where the purchase was made.
5. Refund Policy
Unless required by applicable law, all purchases, subscriptions, digital products, and services are final and non refundable. We do not guarantee refunds for partial subscription periods, unused time, user dissatisfaction, failure to cancel before renewal, or inactivity or non usage. If you believe a billing error occurred, you must contact us promptly. Certain jurisdictions may provide mandatory consumer rights that cannot be excluded.
6. Acceptable Use
You agree not to use the Services unlawfully; share or distribute account access; copy, reproduce, scrape, or exploit content without authorization; upload malicious software or harmful code; interfere with platform functionality or security; harass, threaten, abuse, or impersonate others; post unlawful, offensive, defamatory, discriminatory, or inappropriate content; attempt unauthorized access to systems or user accounts; or use automated systems to extract data from the platform. We reserve the right to remove content, suspend accounts, or pursue legal remedies where necessary.
7. Community Features
If Formelle offers community, chat, comment, forum, or social features, you acknowledge that user generated content reflects the opinions of individual users; we are not responsible for user posted content; we may monitor, remove, restrict, or moderate content at our discretion; and we may suspend users who violate community standards. You grant Formelle a non exclusive, worldwide, royalty free license to use, display, reproduce, and distribute content you voluntarily post within the Services for operational and promotional purposes.
8. Intellectual Property
All content, materials, branding, designs, videos, graphics, software, programs, trademarks, and intellectual property associated with Formelle are owned by or licensed to Formelle and protected under applicable intellectual property laws. You may not copy or redistribute content, create derivative works, reverse engineer software, use Formelle branding without written permission, or commercialize any part of the Services. Limited personal, non commercial use is permitted solely for intended platform usage.
9. User Generated Content
You retain ownership of content you upload to the Services. However, by uploading content, you grant Formelle a worldwide, non exclusive, royalty free license to host, display, reproduce, process, and use such content for purposes related to operating and improving the Services. You represent and warrant that you own or have rights to the content you upload, your content does not violate laws or third party rights, and your content does not infringe intellectual property rights.
10. Third Party Services
The Services may integrate with or contain links to third party platforms, payment processors, wearable devices, analytics providers, or external services. We are not responsible for third party services, third party terms or privacy practices, availability or functionality of external platforms, or losses resulting from third party interactions. Use of third party services is subject to their own terms and policies.
11. Availability of Services
We do not guarantee uninterrupted or error free access to the Services. We reserve the right to modify or discontinue features, restrict access by region, perform maintenance, update pricing or functionality, and suspend or terminate portions of the Services. We are not liable for outages, interruptions, delays, or technical failures.
12. Limitation of Liability
To the maximum extent permitted by law, Formelle and its directors, officers, employees, contractors, affiliates, and partners shall not be liable for indirect or consequential damages, loss of profits or revenue, data loss, business interruption, personal injury, health complications, emotional distress, device or software damage, or unauthorized account access. Your use of the Services is at your sole risk. Where liability cannot be excluded by law, liability shall be limited to the amount paid by you to Formelle during the twelve month period preceding the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Formelle and its affiliates, officers, employees, contractors, licensors, and partners from claims, liabilities, damages, losses, and expenses arising from your use of the Services, your violation of these Terms, your content, or your violation of laws or third party rights.
14. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without notice, where we reasonably believe you violated these Terms, your use poses risk or harm, it is required by law, or it is necessary for operational or security reasons. Termination does not affect accrued rights or obligations.
15. Privacy
Your use of the Services is also governed by the Formelle Privacy Policy. By using the Services, you acknowledge that you have reviewed the Privacy Policy.
16. International Use
Formelle operates from Spain and makes the Services available internationally. You are responsible for ensuring your use complies with laws applicable in your jurisdiction.
17. Governing Law and Jurisdiction
These Terms shall be governed by and interpreted under the laws of Spain, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Spain, unless otherwise required by mandatory consumer protection laws in your country of residence.
18. Changes to These Terms
We may update or modify these Terms at any time. Updated versions will be posted within the Services with a revised “Last Updated” date. Continued use of the Services after updates constitutes acceptance of the revised Terms.
19. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy and any additional policies referenced within the Services, constitute the complete agreement between you and Formelle regarding use of the Services.
